On the 30th anniversary of a little-known but highly consequential law, Harsh Legacy reveals how the 1996 immigration law laid the groundwork for the enforcement system dominating headlines today — families torn apart, asylum seekers treated like criminals, and legal residents facing exile for decades-old offenses.
Now backed by unprecedented congressional funding, expanded enforcement powers, and severe judicial rulings, the law introduced many of the mechanisms that define the current system: mandatory detention and deportation and limits on due process and judicial review.
The film asks: How did a law framed as restoring the rule of law help produce a system of mass detention and deportation? What were its intended goals, and how did its unintended consequences unfold over time? How has it stripped the human rights of immigrants and what does this history reveal about the obstacles to meaningful immigration reform today?
By pairing insider perspectives from the time of the law’s passage with the lived experiences of immigrants and advocates directly affected by the law since then, Harsh Legacy bridges policy and personal narrative, connecting legislative decisions to human consequences.
Conceived as both a documentary film and public education initiative, the project will include discussion guides, teaching materials, and an annotated bibliography to support screenings in academic, policy, and community settings. Through partnerships with universities, and advocacy organizations, the film aims to foster informed dialogue about the history — and future — of immigration policy in America and the urgent need for legislative reform.
